Conditions of Trade 1. The Carrier shall pay Backload Moving Company NZ Ltd a commission (inclusive of GST) equal to the posted rate on customer listings which is no more than 15% of the GST inclusive cartage, labour, and any packing fee, but exclusive of any storage or insurance fee, due from customers introduced by Backload Moving Company to carriers, where the carrier enters into a cartage contract as a result of the introduction. 2. The commission to Backload Moving Company NZ Ltd is payable seven days after performance of the contract with the customer, irrespective of payment by the customer to the Carrier. 3. Should payment not be made by the due date, Backload Moving Company NZ Ltd reserves the right to charge interest on overdue amounts at the rate of interest Backload Moving Company NZ Ltd would normally be charged in respect of monies lent out on overdraft facility to them by its trading bank plus 2% per annum. Any expenses, costs or disbursements incurred by Backload Moving Company in recovering any outstanding amounts including debt collection, agency fees and legal costs as between solicitor and client shall be paid for by the Carrier.” 4. Carriers must follow Instructions for Use of Service issued by Backload Moving Company NZ Ltd, which are updated from time to time, and acknowledge that these instructions form part of these Conditions of Trade. 5. Carriers must immediately inform Backload Moving Company NZ Ltd when they have successfully quoted a customer’s move. 6. In accordance with the Privacy Act, customer contact details are personal information and must not be disclosed to any third party except an alternative carrier engaged by you in urgent circumstances where you are unable to carry out the work. 7. The carrier acknowledges that Backload Moving Company NZ Ltd is a mere booking agent and accordingly will indemnify the Backload Moving Company NZ Ltd in respect of any loss or liability that it might incur as a result of a claim raised against it by a customer. 8.
